DISTANCE SELLING AGREEMENT

1. PARTIES

This Agreement is concluded between the following parties under the terms and conditions set forth below.

By accepting this Agreement, the BUYER acknowledges that confirming the order entails an obligation to pay the specified price (including the product price, shipping, and taxes).

2. SUBJECT AND SCOPE

This Agreement regulates the rights and obligations of the Parties regarding the sale and delivery of the products ordered by the BUYER through the SELLER's website, in accordance with Turkish Law No. 6502 on the Protection of Consumers and the EU Consumer Rights Directive (2011/83/EU).

3. PRODUCT INFORMATION AND PAYMENT

The main characteristics of the products, the sales price including taxes, and delivery information are as displayed on the website at the time of the order. While prices include VAT, the BUYER is responsible for any potential customs duties or import taxes applicable in the destination country for orders placed from outside Turkey.

4. GENERAL PROVISIONS

4.1. The SELLER undertakes to deliver the product complete, sound, and within the legal period of 30 days.

4.2. Legal Guarantee (EU): For consumers within the European Union, a legal guarantee of conformity of at least 2 years from the delivery of the goods is provided. In the event of a defect, the BUYER has the right to request repair, replacement, or a refund.

4.3. If performance becomes impossible, the SELLER shall notify the BUYER within 3 days and refund all payments within 14 days.

5. RIGHT OF WITHDRAWAL (CANCELLATION & RETURNS)

5.1. Period: The BUYER has the right to withdraw from this contract within 14 days without giving any reason.

5.2. Notification: The right of withdrawal must be communicated to the SELLER via email ([email protected]) or a written petition.

5.3. Refund: Upon notification, the BUYER must return the product within 14 days. The SELLER shall refund all payments received from the BUYER, including delivery costs, within 14 days of receiving the withdrawal notice.

5.4. Exceptions: The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized (custom sizes, colors, etc.) or sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

6. DATA PROTECTION (KVKK & GDPR)

Personal data is processed in accordance with the Turkish KVKK and the EU General Data Protection Regulation (GDPR). Detailed information can be found in our Privacy Policy.

7. DISPUTE RESOLUTION AND COMPETENT COURT

7.1. For disputes in Turkey, applications can be made to the Consumer Arbitration Committees or Consumer Courts within the monetary limits set by the Ministry.

7.2. Online Dispute Resolution (EU): Consumers residing in the EU may use the European Commission’s Online Dispute Resolution (ODR) platform to settle disputes: https://ec.europa.eu/consumers/odr.

8. ENFORCEMENT

By completing the payment, the BUYER is deemed to have accepted all terms of this Agreement.
